GDPR's data minimization principle requires collecting only data that's necessary for your purposes. This can conflict with ML's need for large datasets.
You need to justify why you're collecting each piece of data. "We might use it for ML later" isn't sufficient. You need specific purposes.
Purpose Limitation
Data collected for one purpose shouldn't be used for unrelated purposes. If you collect customer data for order processing, using it to train an ML model for marketing requires separate justification.
Transparency
GDPR requires transparency about data processing. For AI systems, this means explaining:
- That you're using AI/ML

- What data is used
- How decisions are made (to the extent possible)
- What rights individuals have
This is challenging when models are complex or proprietary, but you still need to provide meaningful information.
CCPA/CPRA and AI
California's privacy laws also apply to AI systems:
Right to Know
Consumers can request information about how their data is used, including in AI/ML systems. You need to disclose if personal information is used for automated decision-making or profiling.
Right to Opt-Out
CPRA gives consumers the right to opt out of automated decision-making technology. This is broader than GDPR's requirements.
Right to Correct
Consumers can request correction of inaccurate personal information. For AI systems, this means ensuring training data accuracy and allowing corrections that affect model outputs.
Sensitive Personal Information
CPRA includes additional protections for sensitive personal information. If your AI system processes sensitive data (like biometrics, precise geolocation, or health information), you need explicit consent or other legal basis.
Data Protection Impact Assessments (DPIAs)
GDPR requires DPIAs for high-risk processing. AI/ML systems often qualify as high-risk because they:
- Make automated decisions
- Process large amounts of data
- Create profiles
- Process sensitive data
- Use new technologies
If you're implementing an AI system, conduct a DPIA that covers:
- What data you're processing and why
- How the AI system works
- What decisions it makes
- Risks to individuals
- Mitigation measures
- Compliance measures
DPIAs aren't just compliance exercises—they help identify and address privacy risks before they become problems.
Best Practices for AI/ML Privacy Compliance
Here are practices that help ensure compliance:
1. Data Minimization
Only collect data you actually need. Don't collect "everything" just because ML might find patterns. Have specific purposes for each data point.
Consider techniques like:
- Differential privacy (adding noise to protect individuals)
- Federated learning (training models without centralizing data)
- Synthetic data (using generated data instead of real data)
2. Purpose Specification
Be specific about why you're using AI/ML. "To improve our services" is too vague. "To personalize product recommendations based on purchase history" is better.
3. Transparency
Explain your AI systems clearly:
- What decisions are automated
- What data is used
- How individuals are affected
- What rights they have
Use plain language. Technical explanations don't help if users can't understand them.

- Secure model access
- Protect against model inversion attacks
- Monitor for unauthorized access
8. Documentation
Document your AI systems:
- What data is used
- How models are trained
- What decisions are made
- How accuracy and fairness are ensured
- How rights are honored
This documentation helps with compliance audits and responding to data subject requests.
Common Compliance Mistakes
Here are mistakes I see businesses make:
Not disclosing AI use. Failing to mention in privacy policies that you use AI/ML for decision-making.
Collecting too much data. Gathering data "just in case" it's useful for ML, without specific purposes.
Lack of transparency. Not explaining how AI systems work or what decisions are automated.
No human review. Failing to provide ways for individuals to challenge automated decisions.
Ignoring bias. Not testing for or addressing bias in models, leading to discriminatory outcomes.

Don't assume that because you're using cutting-edge technology, privacy laws don't apply. They do, and compliance is essential.
Start by auditing your AI/ML systems. What data do they use? What decisions do they make? How transparent are you? Then build compliance into your systems from the start.
AI offers incredible opportunities, but it also creates privacy responsibilities. Meet those responsibilities, and you can use AI effectively while maintaining compliance and user trust.
